Suspected Spam Client

Hi guys,
Just want to ask a few questions about a spam client. I have just had some guy pay for 2 years of my reseller hosting. Just out of look i clicked on his account to view current files and found what appeared to be a SPAM MAIL SYSTEM.

I have temporary suspended the account but what am i allowed to do? Am i even allowed to suspend him? Am i allowed to terminate him?
What would you guys do? (Obviously i cannot prove any spam has even come out of the account yet as its just been created.

It's pretty standard to terminate the account and refund for these cases.

Shoot first, ask questions later.
Refund? For spammers? I don't think so.
Better keep that as payment for the PITA, as you may find yourself on blacklists.

Well he replied to a ticket and said 'sorry, i will delete' so we told him we would unban the account and if any spam is sent would result in account termination. well. On his site now all it says is 'THANK YOU' he didn't request a refund....
Will be keeping a close eye on him as i would not like to blacklist our new server!

In most of these cases, spammers use stolen credit cards. So you may expect a chargeback, which may eventually increase your "hold" amount by your merchant account provider and also chargeback penalty fees. Its always wise to issue a refund in these cases.

You're allowed to do whatever the TOS that he has been bound to has stated.
Here's what I would do: contact the client, opening a "Security" ticket with them. Let them know about the issue, and do some research. See if they were perhaps hacked or if they were a spammer. See how the file got on the server, checking FTP logs, etc. This is something that your reseller host will be able to help with (seeing how the file got there). Take action after you have all the information

I had issued a refund after reading somebodys thread on these forums. That these sort of people are using stolen money, that is why he bought 2 years in advance without even contacting us.

Be careful not giving refunds. If they're happy to spam people they may be happy to DDoS or cause other headaches for you. A lot of the time the refund is the wiser option.
I have to laugh at the 'victim' variable though

It doesn't matter if you refund it or not. They will just charge it back even if you refund it or report the money stolen but more likely you'll pay as much in the future.

Issuing a refund is always the wiser option as the payments for these types of accounts usually always end up being fraudulent and a chargeback issued at some point.
It's just not worth the chance of the $25-$35 chargeback fee not to refund the account.
